Legal Acknowledgement
1. Introduction and Purpose
This Legal Acknowledgement ("Acknowledgement") sets forth the terms and conditions governing your use of laboratory testing services ordered through this platform. By completing this form and proceeding to the lab ordering portal, you acknowledge that you have read, understood, and agree to be bound by the terms described herein. This Acknowledgement constitutes a legally binding agreement between you ("Patient," "you," or "your") and the ordering organization ("Provider," "we," "us," or "our").
2. Nature of Services
The laboratory tests available through this platform are intended for informational and wellness purposes only. These tests are ordered by a licensed healthcare provider on your behalf and are processed by CLIA-certified laboratories. The results of these tests do not constitute a medical diagnosis and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
3. Informed Consent for Laboratory Testing
By proceeding, you voluntarily consent to the collection and analysis of biological specimens (including but not limited to blood, urine, saliva, or other bodily fluids) as required by the ordered laboratory tests. You understand that specimen collection involves certain inherent risks, including but not limited to bruising, fainting, infection at the venipuncture site, excessive bleeding, or hematoma formation.
4. Accuracy and Limitations of Results
While laboratory tests are performed using validated methodologies and meet established quality standards, no test is 100% accurate. Results may be affected by factors including specimen handling, timing of collection, recent dietary intake, medications, supplements, and individual biological variability. False positive and false negative results are possible. You understand and accept these inherent limitations.
5. Use of Results
You agree that laboratory results provided through this service are for your personal informational use. You are strongly encouraged to share your results with your primary care physician or other qualified healthcare provider for proper interpretation in the context of your complete medical history. You should not make changes to medications, treatments, or health practices based solely on these results without consulting a qualified healthcare provider.
6. Privacy and Data Handling
Your personal information, including your name, email address, and acknowledgement record, will be collected and stored for recordkeeping and compliance purposes. Laboratory results and associated health information are handled in accordance with applicable privacy laws and regulations. We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, or disclosure.
7. Third-Party Laboratory Services
Laboratory testing is performed by independent, third-party CLIA-certified laboratories. We do not operate, control, or assume responsibility for the laboratory facilities, their testing procedures, or the conduct of their personnel. Any claims related to the laboratory testing process, specimen handling, or result accuracy should be directed to the performing laboratory.
8. No Physician-Patient Relationship
Completing this acknowledgement and ordering laboratory tests through this platform does not establish an ongoing physician-patient relationship. The ordering provider's involvement is limited to reviewing and authorizing the laboratory test orders. For ongoing medical care, diagnosis, and treatment, you should consult with your personal healthcare provider.
9. Financial Responsibility
You understand that the fees associated with laboratory testing are your responsibility. These services are typically not billed to insurance unless explicitly stated otherwise. All fees are non-refundable once specimen collection has occurred. You agree to pay all applicable fees at the time of ordering or specimen collection as required by the platform or laboratory.
10. Age and Capacity
By completing this acknowledgement, you represent that you are at least 18 years of age and possess the legal capacity to enter into this agreement. If you are completing this acknowledgement on behalf of a minor or a person under your legal guardianship, you represent that you have the legal authority to do so and accept these terms on their behalf.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Provider, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of laboratory testing services, including but not limited to damages for loss of profits, data, or other intangible losses, even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Provider, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the laboratory testing services, your violation of these terms, or your violation of any rights of a third party.
13. Governing Law and Dispute Resolution
This Acknowledgement shall be governed by and construed in accordance with the laws of the state in which the Provider is organized, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Acknowledgement shall be resolved through binding arbitration administered in accordance with applicable rules, and judgment on the award may be entered in any court having jurisdiction.
14. Severability
If any provision of this Acknowledgement is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render this Acknowledgement unenforceable or invalid as a whole. Any such provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent of the parties.
15. Amendments and Modifications
The Provider reserves the right to update, modify, or replace these terms at any time. Material changes will be communicated through reasonable means, such as a notice on the platform. Your continued use of the laboratory ordering services after any such changes constitutes your acceptance of the revised terms. It is your responsibility to review this Acknowledgement periodically for updates.
16. Electronic Signature and Records
By entering your full name below and submitting this form, you agree that your electronic signature is the legal equivalent of your handwritten signature and that it carries the same legal force and effect. You consent to the use of electronic records for the purposes of this Acknowledgement and agree that electronic records satisfy any requirement that these terms be provided to you in writing.
